Terms of Service

Please read these Terms of Service carefully before using our website or booking any travel package with Velmora Safaris & Sands. These terms govern your relationship with us and outline your rights and responsibilities as a customer.

1. Acceptance of Terms

By accessing or using the Velmora Safaris & Sands website, making an enquiry, or booking any of our travel packages, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our services.

2. Our Services

Velmora Safaris & Sands is a travel company based in Nairobi, Kenya, offering curated safari packages, beach holidays, mountain expeditions, and custom travel experiences across Kenya and beyond. We act as a travel organiser and may work with third-party accommodation providers, transport operators, and park authorities to deliver your trip.

3. Bookings & Confirmations

A booking is considered confirmed only after you have received a written confirmation from Velmora Safaris & Sands via email or WhatsApp, and a deposit or full payment has been received. Verbal agreements or enquiry form submissions alone do not constitute a confirmed booking. We reserve the right to decline any booking at our discretion.

4. Pricing

All prices listed on our website are per person unless stated otherwise, and are subject to change without notice until a booking is confirmed. Prices are quoted in Kenyan Shillings (KES) or US Dollars (USD) as indicated. Any applicable taxes, park fees, or surcharges will be communicated to you before confirmation. We are not responsible for currency fluctuation losses.

5. Payment Terms

We accept payment via M-Pesa (Paybill 542542), bank transfer to I&M Bank, or cash at our Nairobi office. A deposit of at least 30% of the total package price is required to confirm a booking, with the balance due no later than 14 days before the travel date. For bookings made within 14 days of departure, full payment is required at the time of booking. Payments are non-transferable between bookings.

6. Cancellation & Refund Policy

Cancellations must be made in writing via email to safariandsands@gmail.com. The following cancellation fees apply: cancellations made 30 or more days before departure — full refund minus a 10% administrative fee; cancellations made 15–29 days before departure — 50% refund; cancellations made 8–14 days before departure — 25% refund; cancellations made 7 days or fewer before departure — no refund. Please note that refund eligibility may vary depending on the cancellation policies of the respective hotels, lodges, airlines, or other service providers involved in your booking. Refunds, where applicable, will be subject to the terms and conditions of the individual facility or supplier.

7. Changes to Bookings

Requests to change travel dates, package inclusions, or the number of travellers must be made in writing and are subject to availability. Changes made within 14 days of departure may incur additional fees. We will do our best to accommodate changes but cannot guarantee them.

8. Travel Documents & Requirements

It is your responsibility to ensure you hold a valid passport, any required visas, and any necessary vaccinations or health documentation for your destination. Velmora Safaris & Sands is not liable for any costs, losses, or denied entry resulting from failure to meet entry requirements.

9. Travel Insurance

We strongly recommend that all travellers obtain comprehensive travel insurance covering trip cancellation, medical emergencies, evacuation, and loss of personal belongings before departure. Velmora Safaris & Sands does not provide travel insurance and is not liable for costs that would have been covered by insurance.

10. Liability

Velmora Safaris & Sands acts as an organiser and coordinator of travel services provided by independent third parties including hotels, lodges, transport operators, and park authorities. We are not liable for any injury, loss, damage, delay, or inconvenience caused by the acts or omissions of these third-party providers, or by circumstances beyond our reasonable control including but not limited to weather, natural disasters, political unrest, or strikes. Our total liability to you shall not exceed the total amount paid for your booking.

11. Health & Safety

You are responsible for ensuring you are physically fit and medically able to participate in the activities included in your chosen package. You must inform us of any medical conditions, dietary requirements, or accessibility needs at the time of booking. We reserve the right to exclude any traveller from an activity if we reasonably believe their participation poses a risk to themselves or others.

12. Behaviour

We expect all travellers to behave respectfully towards our staff, guides, local communities, wildlife, and the natural environment. We reserve the right to terminate the trip of any traveller whose behaviour is deemed disruptive, dangerous, or disrespectful, without refund.

13. Photography & Marketing

By booking with us, you consent to Velmora Safaris & Sands using photographs or videos taken during your trip for marketing and promotional purposes, including on our website and social media. If you do not wish your image to be used, please notify us in writing before your trip.

14. Intellectual Property

All content on this website including text, images, logos, and design is the property of Velmora Safaris & Sands and is protected by copyright. You may not reproduce, distribute, or use any content without our prior written permission.

15. Governing Law

These Terms of Service are governed by the laws of the Republic of Kenya. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Kenya.

16. Changes to These Terms

We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with a revised effective date. Continued use of our website or services after changes are posted constitutes your acceptance of the updated terms.
